  • Marketing and personalization of online advertising

Personalized advertising is one of the means by which a company can promote its products and services online to customers or potential customers. Companies use various tools to collect online and offline user data (including customer data) to show them content and advertisements based on their behavior and interest categories relevant to them.

The purpose of this endeavor is to understand the needs of users and provide an improved experience with regard to the products and services promoted.

We use such tools and strive to manage them in an appropriate manner and in accordance with the provisions of data protection legislation, without ads or advertising content impacting your online experience and rights.

Personalized Advertising becomes relevant to your needs based on the amount of information we obtain or hold about your socio-demographic profile, interests and behavior online and offline . Such information is generally collected (i) from partners who provide our tools, (ii) when you interact with certain pages of our Site, or (iii) from interaction with our professional social media pages (and namely Facebook, Instagram and LinkedIn), and are provided to us in the form of statistics and aggregated data (for example, a number of 3,234 people accessed the My Account section of the Site).

  • if we do not hold information about you

We use tools that help us run online campaigns to users of our partners’ products and services . These tools do not allow us to view or access personal data about these users (for example, name, surname, phone numbers or email addresses), but only to establish certain criteria based on (i) socio- demographics (age segments – for example, 19-29 years old -, gender and location at country or regional level) and (ii) areas of interest, based on which the partners will choose and segment the audience to which to deliver personalized advertising. The selection of users is made solely on the basis of data that these partners collect from interaction with their services and products.

These tools also allow us to track in real time the results of the campaigns thus launched in the form of statistics and aggregated data . With the example title, we have access to the total number of views and accesses of the advertising content transmitted (called “impressions”).

We create and run campaigns from:

  1. Facebook Ads Manager – campaigns run in Facebook, Instagram, Messenger, Audience Network

You can learn more about how Facebook, Inc. and its affiliated companies collect, process and protect personal data by accessing the sections “What types of information do we collect?” and “How do we use this information?” at the following link: https://www.facebook.com/privacy/explanation# .

Facebook also provides a mechanism by which you can manage the interests collected and the companies from which you receive advertising content. How you can access such settings is described at the following link: https://www.facebook.com/help/568137493302217

  1. Google Ads – campaigns run through Google services and products (e.g. Google Search, Youtube, Google Maps, etc.)

You can learn more about how Google LLC. and its affiliated companies collect, process and protect personal data by accessing the “Information collected by Google” and “Why Google collects data” sections at the following link: https://policies.google.com/privacy?hl=ro .

Similarly, Google has developed a mechanism that can be accessed at the following link https://adssettings.google.com/?utm_source=pp&hl=ro through which you can opt for personalized advertising content or manage your demographic characteristics and interests.

Legal grounds: (i) our legitimate interest justified by the need to analyze (i) the results of the campaigns carried out and the investments made in the promotion of advertising content and (ii) the performance of the tools provided by our partners. (ii) your consent collected by Facebook and Google to receive personalized advertising from partners.

  • if you have been the subject of previous campaigns or interacted with professional pages or our Site

With your permission, we may collect statistical and aggregate information about how you interacted with our Site through cookies or other tracking technologies.

We use so-called tracking technologies through our Site and professional pages to ensure that we deliver advertising content that is relevant to you. Your actions within these media are recorded and assigned to a unique device identifier that you use, consisting of a string of letters and numbers. These technologies do not allow us to identify you personally, but based on the unique identifier, our partners can show you advertising content set by us through their Websites and the products and services they provide to you.

Our advertisements will only be shown to you if you have previously expressed interest in our products and services by accessing the Site and, where applicable, have consented to the collection of information regarding your interaction with the Site through the permissions granted in our preferences center.

Regarding our professional pages, our partners track your interaction with them (for example, when you press the “like” button for the page or for a certain event organized by us), collect this statistical information and aggregate it in order not to allow your identification. Using the tools provided by them we can carry out advertising campaigns to an audience composed strictly of people who have interacted in one way or another with our professional pages.

In order to personalize advertising content, we use:

  • Tools for tracking your actions on the Site:
  • Google Marketing Platform – Floodlights/Google Ads

It is a service provided by Google LLC., which uses cookies to show you advertisements relevant to you. These cookies use a personalized identifier (ID) to verify which advertisements have been displayed in your device’s browser. Cookies do not contain personal information that can directly identify you, and their use allows Google, its affiliated companies and its partner Sites to display advertisements based on your previous visits to our Site.

You can opt-out or opt-out of the collection of this information about you by Google:

  • from our preferences center;
  • using your device’s browser settings
  • accessing our Site through the Private/Icognito functionality of the browser you are browsing from.

You can find out more information about how Google LLC and its affiliated companies collect, process and protect personal data by accessing the sections “Information collected by Google” and “Why Google collects data” at the following link: https://policies.google .com/privacy?hl=en .

Similarly, Google has developed a mechanism that can be accessed at the following link https://adssettings.google.com/?utm_source=pp&hl=ro through which you can opt for personalized advertising content or manage your demographic characteristics and interests.

Legal Basis: Your consent to customize advertising content based on your interests.

  • Facebook Conversion Tracking Pixel/Facebook Site Custom Audiences Pixel

It is a piece of code inserted into the Site that helps us track the activity of users redirected from an advertising campaign run on Facebook. When you visit our Site, this tracking tool is used to establish a direct connection between your device’s browser and Facebook servers.

In this context, Facebook receives information from your browser, including the fact that your terminal has accessed our Site and if you are a user of Facebook services or products, through this tool it can attribute your visit to the Site- our your user account. We would like to emphasize that we are not aware of the content of the transmitted data or how it is used by Facebook. The platform associated with the tracking tool only allows us to select certain segmentation criteria in which users have been classified by Facebook (eg, based on age, geographic location or expressed interests) to which Facebook will display our advertisements.

However, in this case, no set of data that can lead to your identification, in particular e-mail addresses or telephone numbers, will be transferred to Facebook or used for the transmission of Personalized Advertising.

You can opt-out or opt-out of Facebook collecting this information about you:

  • from our preferences center;
  • using your device’s browser settings
  • accessing our Site through the Private/Icognito functionality of the browser you are browsing from.

You can find more information on this topic in Facebook’s privacy policy at https://www.facebook.com/about/privacy/ .

Facebook also provides a mechanism by which you can manage the collected interests and the companies from which you receive advertising content. How you can access such settings is described at the following link: https://www.facebook.com/help/568137493302217

Legal Basis: Your consent to customize advertising content based on your interests.

  • Other tools used to deliver personalized advertising
  • Google Ads and Remarketing Lists

It is a service that allows us to display advertising content to people who have visited our Site. Advertisements may be displayed when you use services provided by Google (eg Youtube, Gmail, Google Search, etc.). If, as a result of your interaction with any of the ads published in the Google network, you are redirected to our Site, Google collects this information by means of cookies and generates aggregate statistics about the campaign run. These statistics can later be used for the retransmission of advertisements according to certain segmentation criteria, or with the help of Google Analytics we can perform a statistical evaluation of the data from Google Ads that helps us understand how we can optimize the transmitted advertising content.

You can find out more information about how Google LLC and its affiliated companies collect, process and protect personal data by accessing the sections “Information collected by Google” and “Why Google collects data” at the following link:  https://policies.google .com/privacy?hl=en .

You can opt-out or opt-out of the collection of this information about you by Google:

Legal Basis: Your consent to customize advertising content based on your interests.

  • Facebook Insights – our Facebook page allows us to actively communicate with our customers and stakeholders. We use this platform to provide information about our offers and other events that you can participate in.

When you visit our Facebook page, your personal data may be collected and stored by Facebook for the purpose of market research and the delivery of personalized advertising. The information is collected by Facebook in a pseudonymized format to create user profiles and does not allow us to identify you directly. For this purpose, Facebook places cookies on your device that store your behavior and interests.

More information about this functionality is available at the following link: http://en-gb.facebook.com/help/pages/insights .

Data processing is carried out on the basis of an agreement between jointly responsible parties pursuant to Article 26 of the GDPR. You can read this agreement here:

https://www.facebook.com/legal/terms/page_controller_addendum .

In this case, we only receive statistical information about users who have accessed our business page and we have no control over the information collected and processed by Facebook. However, Facebook provides an opt-out mechanism available here:

https://www.facebook.com/settings?tab=ads

Legal Basis: Our legitimate interest in managing and improving our services and maintaining active and effective communication with customers and stakeholders.

  • Other professional pages – We have created and manage professional pages accessible to the public in the social networks of LinkedIn and Instagram (from Facebook).

Social networks may perform complex analyzes of your behavior as a user of these platforms, when you visit their Sites or a Website with integrated social media content (for example, “like” plugins or advertising “banner”).

In general, if you visit one of our professional social media pages while logged in to your social media account, the operator of the social media portal may attribute this visit to your user account. In certain circumstances, your personal data may also be recorded when you are not logged in or do not have an account on that social media portal. In this case, the collection of your data is carried out, for example, by using cookies saved on your device. As administrators of these pages, we receive statistical and aggregated information from the operators of the platforms.

The providers of the social media platforms may use the data collected in this way to create user profiles in which your preferences and interests are stored. These profiles may be used by the operators of the platforms to show you advertising content tailored to your interests, both within the social media platform’s internal network and outside of it.

If you have a registered account with that social network, personalized advertising ads may be displayed on all devices on which you are or have been logged in. You can find details of such further processing in the terms and conditions of use and privacy policies of the respective social media portals.

When you visit one of our professional social media pages we are responsible together with the operator of the social media platform for the data processing operations triggered by this visit. Basically, you can exercise your rights (access, rectification, deletion, restriction of processing, data portability and complaint) both against us and against the operator of the respective social media portal (for example, against Linkedin).

Please also note that despite our shared responsibility with the operators of the social media platforms, we are unable to follow and cannot decisively influence the processing operations carried out on the social media platforms, in particular with regard to the categories of collected data.

LinkedIn

We have created a page on the LinkedIn platform ( https://www.linkedin.com/company/chilli-ideas/ ) dedicated to help us identify, connect and maintain business relationships with potential partners, service providers or skilled labor.

This service is provided by Linkedin Ireland Unlimited Company and allows us to monitor and grow our audience on this platform, as well as serve Personalized Advertising to a specific audience, without the information provided by LinkedIn being able to identify you directly.

In order to regulate the responsibilities of each party, we have concluded a data processing agreement with Linkedin which you can access at the following link: https://legal.linkedin.com/pages-joint-controller-addendum .

For more information about the data processing that LinkedIn does in relation to the services offered, please read LinkedIn’s privacy policy: https://www.linkedin.com/legal/privacy-policy .

Instagram from Facebook

In addition to the Facebook page, we also manage an Instagram page ( https://www.instagram.com/chilli_ideas /), a service provided by Facebook Inc. In order to regulate the responsibilities of each party, we have concluded a data processing agreement with Facebook regarding the joint processing of data. This agreement states which data is processed by us and which is processed by Facebook whenever you visit our Instagram page. You can read this agreement by accessing the following link: https://www.facebook.com/legal/terms/page_controller_addendum

For more information about the data processing that Facebook does with regard to the services offered through the Instagram platform, please read Facebook’s privacy policy: https://www.facebook.com/about/privacy

Legal basis: our legitimate interest to have a solid online presence and to understand the characteristics of the audience of these pages

  • if we use directly identifiable data
  • Google Ads – Remarketing Customer List and Facebook Ads Manager – Custom Audience from a list

With your permission, we may combine your identifying information (name, surname, email address, phone number, geographic area, and postal code) with data held by our vendors to deliver personalized advertising to you.

Both Google and Facebook offer their own solutions (ie, Google Ads – Remarketing Customer List and Facebook Ads Manager – Custom Audience from a list) that allow us to transmit your identification data to them for integration into a selection process and audience segmentation. This data transfer is done in a secure way, using an encryption algorithm that ensures the confidentiality of your data in transit and at the time of processing. Following the matching process, that solution generates specific audiences based on which we can determine what kind of promotional content to send you.

However, the results of this segmentation do not allow you to be identified directly. Specifically, following the matching process, we will not be able to know whether you have been chosen to be part of the audience selected by these partners (for example, from a list of 100,000 customers, Google may return us an audience of 5,000 potential individuals who can receive Personalized Advertising, but without concretely identifying you in the platform).

Legal Basis: Your consent to customize advertising content based on your interests.

Transfer of data to third countries

In some cases, for the purposes described above, data may be transferred to countries outside the European Economic Area (EEA). These countries do not have a data protection standard comparable to that of the EU (eg USA, China or India). For the protection of your data, we will ensure that the transfer to non-EEA contractual partners that do not provide an adequate level of protection is carried out on the basis of EU standard contractual clauses for the transfer of personal data to third countries. If the transfer will not be based on such clauses, we will ensure that the transfer is always based on another mechanism provided by law to ensure the protection of your personal data.

You can consult the EU standard contractual clauses for the transfer of personal data to third countries at the following link:

https://ec.europa.eu/info/law/law-topic/data-protection/international-dimension-data-protection/standard-contractual-clauses-scc_ro

Facebook – https://www.facebook.com/legal/EU_data_transfer_addendum

Google – https://privacy.google.com/businesses/processorterms/mccs/

Changing purposes

The processing of your personal data for purposes other than those described will only take place to the extent permitted by a legal regulation or subject to your consent to change the purpose of data processing. In the event of further processing for purposes other than those for which the data were originally collected, we will provide you with all relevant information.
