(1) Prominate EMEA will perform delivery of goods based on “as soon as possible” principle. The estimated delivery time will be mentioned on each product page and will depend on stock availability and the country of destination.

The order dispatch time is generally 1 full working day if all the items are in stock.

For non-stock items, Prominate EMEA will inform Veeam in writing (by email) the appointed period / the appointed date. However, the period of delivery shall be prolonged to another individually agreed term, if Veeam does not perform the owed cooperation for delivery (see § 2 of the present Terms).

(2)  Prominate EMEA takes responsibility for goods customs management.

In some cases, or to some destination countries, to get custom clearance Prominate EMEA is required to provide some specific documentation such as Power of Attorney from Veeam to import products that have Veeam branding on them. The requirement of specific documentation must be confirmed by Prominate to Veeam once the order is requested. Veeam will cooperate in timely manner to obtain the required documentation.

(3) For the duration of the examination by Veeam of printed materials, samples, clichés, etc., the period of delivery shall always be interrupted, and namely from the day of the dispatch to Veeam until the day of the receipt of his/her opinion.

(4) In certain cases of custom orders Prominate can give an estimated delivery period and not a firm delivery date due to the external factors (e.g. Christmas, Chinese New Year, Black Sea ports blocked).

If the item or items are not delivered to the recipient or to the defined location after a month from the initial delivery period end date, then this order or part of the order is considered unexecuted and Veeam must be refunded for the items and delivery costs.

(5) If Veeam demands a modification of the order after Prominate EMEA has already confirmed the order, and this modification may affect the duration for preparation of delivery for Prominate EMEA, a new period for delivery begins to run after Prominate EMEA has confirmed the modification. 


(6) Prominate EMEA shall not be responsible for a delay of the delivery as a result of force majeure, which derives from circumstances which Prominate EMEA cannot influence during the execution of the contract, being industrial action (protests, striking, working to rule), national holidays, high season for deliveries such as close to religious holidays (e.g., Christmas), Non-EU countries deliveries,  where items could be held by Customs. The chance of such delayed delivery will be highlighted to Veeam upon the order placement, so that the timeline is communicated and managed by Veeam team accordingly.  Prominate EMEA takes responsibility for goods customs management. Any items that are classified as Dangerous Goods will be identified by Prominate EMEA and confirmed to Veeam accordingly (e.g., Batteries) as to avoid the situation of items that could be held in customs.

(7) Prominate EMEA will not perform partial delivery unless the parties agree explicitly on this matter. In such cases Prominate EMEA is entitled to issue partial invoices. 

(8) Veeam may cancel product orders containing Catalogue Products or any portion thereof prior to shipping of the relevant Products, unless express delivery has been requested, whereby Orders may have already been shipped. Fulfillment charges incurred up to point of order cancellation such as picking & assembly fees will be billed to Veeam.

(9)  Veeam may cancel Non-Catalogue Product orders or any portion thereof with no additional costs prior to manufacture or customization of the relevant Products, provided that Veeam will be responsible for reasonable manufacturing setup or sample production costs incurred up to the point of order cancellation related to such Products.

(10) For Catalogue Products that are not in stock (on demand items), the delivery time estimation can be found on each product page.
